The Conewago Township Board of Supervisors held their regular monthly meeting, Wednesday, June 12, 2002. Those present were:

The meeting was called to order by Chairman, John Graybill at 7:30 P.M.
MINUTES - May 8, 2002 - A motion by Rochat, second by Graybill to approve the April 10, 2002 minutes as submitted. Motion carried
MINUTES - May 15, 2002 - A motion by Rochat, second by Graybill to approve the May 15, 2002 minutes as submitted. Motion carried.
TREASURER'S REPORT - May 31, 2002 - A motion by Graybill second by Rochat to approve the Treasurer's Report dated May 31, 2002 subject to audit. Motion carried.
EXPENDITURE REPORT - June 12, 2002 - A motion by Graybill second by Rochat to approve the expenditure report dated June 12, 2002 in the amount of $44,685.71. Motion carried.
SUBDIVISION/ENGINEERING FEES & PLAN STATUS REPORTS - Submitted bills for subdivision/engineering fees to Harvey Gipe, Jr., Richard Leininger, Penn Hershey Sports Training Center.
PLANNING COMMISSION MINUTES - May 20, 2002 - For review only.
PUBLIC COMMENTS: Elkton Sparkler Co. - Temporary Permit - Michelle Emil ask for a temporary permit to setup a 20 x 30 ft. tent for purpose of selling sparklers and novelty items on the parking lot of University Music, 3514 Elizabethtown Rd., Hershey, PA from 6-27-02 to 7-4-02. She was given a building permit application and upon receipt of application and approval from zoning officer, a temporary permit will be issued.
PUBLIC COMMENTS CONTINUED: Daniel and Hope Hungler, 3990 Roundtop Road - As parents and residents they are concerned for the safety of their child or anyone in the township. There have been several accidents at this address, the most recent on May 29, 2002 when a car came around the curve and landed in their yard. The car was stopped by a tree stump. which was against the ladder on the swing set, right near where their child was playing in a sandbox. the speed limit is 35 MPH, but cars travel much faster. This area has a school bus stop both direction. The Hungler's would like a traffic study done with possibly slow signs on road, and enforcement warnings when speeding. Motion by Graybill, second by Rochat to send a letter to the State Police for enforcement of speed. Motion carried.
PROPERTY MAINTENANCE CODE - The township engineer gave the Board a copy of a Property Maintenance Code for review. Any comments from the Board shall be forwarded to the Solicitor; who will draft an Ordinance for adoption.
ACT 537 - STATUS REPORT - Ralph Watters, DTMA reported that Derry Township is caught up to where Conewago Township is in our planning and design. Ralph spoke with engineers to sec where they arc with design and all the sewage piping is finished and they are now working on pump stations. The schedule we are working for is that the design be done by end of August, 2002, DEP approval for the extension by end of September, 2002. We also will advertise bids for job by end of September, contract by end of October and the project underway by December, 2002. The one thing that could hold DTMA up is that they did not receive right-of-way plans for Conewago's Township portion for couple of houses. Mr. Watters is also keeping any eye on where to locate the large pumping station off Roundtop Road. Mr. Watters does not know where Dowhower's are in their planning process and we would not have that piece of land available. The Township Engineer received Dowhower preliminary plan for review today and they will be on Planning Commission Agenda for June. The discussion the township engineer had with them is they will follow-up quickly with final plan by September. Mr. Watters is contemplating a mailing to Deny Twp. residents regarding update on project, to let them know where they arc. A letter could be supplied for Conewago residents. The next thing is for DTMA is to get Intermunicipal Agreement by July or August, between Conewago Township and DTMA.
LOWER DAUPHIN AREA REGIONAL PLANNING GROUP - They are still gathering information. Next meeting is June 26, 2002.
NEWSLETTER - The Township Engineer is waiting for information from Kelly Wolf, Dauphin County Department of Solid Waste Management & Recycling regarding the recycling containers placed At the Township Building.
CONEWAGO WATERSHED MEETING - Nothing to report.
OLDS MANAGEMENT PROGRAM - AREA 2 - The following people did not move into their homes until Year 2000: James Bouquet, Parcel 22-2-11, August 2000; Douglas Erney, Parcel 22-2-115, May 2000; James Mulligan, Parcel 22-2-116, August 2000, and George Giangi, Parcel 22-2-113, May 2000. Motion by Rochat to exempt the names above, and send them a letter stating pumping due 2003 and inspection due 2006, and also code in GIS computer, second by Graybill. Motion carried.
Also ask for Kathryn Eshelman, Parcel 22-4-18 located on Schoolhouse Rd. be exempt because septic system hasn't been used in years. Motion by Rochat to exempt Eshelman from inspection and pumping for year 2001, but property may not be occupied until pumped and inspected, second by Graybill.
Kelly Fridey, Parcel 22-2-112, used Peterson Bros. who are not on our approved pumpers list, to pump and inspect her septic system. They were sent paperwork to get on our list, but are not certified to fill out all the onlot sewage papers. She has 3 tanks and didn't want to pay again, but she wanted Walter's to fill out paperwork for her. Walter's wanted to know if it was all right to fill out pumping papers, if he didn't do the pumping. Walter's doesn't feel comfortable doing that, and the Board said they could not give permission for him to do that, if he didn't actually do the pumping. Kelly will have papers filled out properly even if she has to pay someone else to do.
ROBERT GRAYBILL - WAIVER OF LAND DEVELOPMENT - Mr. Graybill is tearing barn down located in Derry Twp and rebuilding it at 745 Gates Road in Conewago Twp. He needs to do stormwater control, and the setback is adequate. A motion by Rochat to approve waiver of land development subject to approval of Zoning Officer and Engineer Officer review. It was noted that Mr. Graybill is not in compliance with OLDS Management Program and upon condition of approval he needs to do a pumping and inspection when building permit is issued., second by Graybill. Motion carried.
PENN HERSHEY SPORTS TRAINING CENTER - Land Development Plan - Elizabethtown, Road. The purpose of this plan is to replace the volleyball field area with (80' x 130') storage units.
WAIVER - A motion by Rochat second by Graybill to grant the waiver for sidewalks and curbs. Section 616, 607 and also Preliminary Plan requirements of Section 403.1. Motion carried.
LAND DEVELOPMENT PLAN - A motion by Rochat second by Graybill to approve the plan upon proper signatures, meeting the Township Engineers comments date February 25, 2002. In addition the Township Engineer needs to approve the grading for water run-off. Motion carried.
RICHARD W. AND ORPHA W. LEININGER - Preliminary/Final Subdivision Plan, 4633 Colebrook Road, Hershey. The purpose of this subdivision is to subdivide a 31.848 acres into 3 lots. Lot #1 will be 19.733 acres and be used for agricultural purposes only, with no construction at this time. Lot #2 is 10.152 acres with existing buildings and may not be further subdivided. Lot #3 will be 1.963 acres and will be added to other lands owned by Richard and Orpha Leininger and cannot be conveyed as a separate building lot.
WAIVERS: Section 403.1 - Preliminary Plan Submission
Section 407.1 .A. 17 - Erosion and Sedimentation Control Plan. (No Construction or earthmoving.)
A motion by Graybill second by Rochat to approve the above waivers. Motion carried.
SUBDIVISION PLAN - A motion by Rochat second by Graybill to approve the plan subject to the Township Engineer's comments dated February 25 and May 8, 2002. The plans needs to have proper signatures and be notarized. Motion carried.
ZONING HEARING BOARD - Authorization to Transfer Files from James, Smith, Durkin & Connelly, LLP to be effective May 31, 2002 to Steven A. Stine. Steven is leaving the firm to start his own practice. The Board is giving the Zoning Hearing Board the choice to stay with Steven Stine, if fees are same and they are satisfied with his services.
AGREEMENT TO CONNECT TO DERRY TWP SEWER - Bernard & Rosalie Sarfert of 236 Laurel Drive, Hershey, PA. brought agreement to connect to Derry Twp. sewer to be signed. Motion by Rochat to authorize signing of Conewago & DTMA and to execute two contract for Sartre's to be connected to DTMA Sewage, second by Graybill. Motion carried.
Motion by Graybill to adjourn meeting at 9:45 PM, second by Rochat. Motion carried.
